DN&P How do websites such as this operate without having to comply with Know Your Customer (KYC) requirements?

It is concerning that websites such as sdc.com or fabswingers.com (UK) do not seem to employ any age verification mechanisms beyond a simple pop-up when entering the site, and some don't even have that. It raises questions about their compliance with legal regulations, especially given the increasingly strict rules for age verification in both the EU and the US. It is worth noting that platforms such as Instagram have recently introduced video age verification for their users, which makes the lack of similar measures on adult websites seem even more questionable.

I share your curiosity about this matter. It would be advisable for adult websites to introduce a mechanism where they request identification from their visitors. This would help prevent underage children from easily accessing the content by simply clicking "yes" when prompted about their age, similar to the process of buying alcoholic beverages.

I am skeptical that there is a significant number of teenagers actively seeking swingers forums. Moreover, these laws are primarily applicable to prominent organizations.

I don't have the GDPR (General Data Protection Regulation) implemented on any of my blogs in the European Union, even though it is legally mandated. Surprisingly, Adsense shows no concern about it, and I have never received any complaints.

Regarding age verification and adult content, have you recently visited websites such as Pornhub, Xhamster, or Xvideos?

I apologize for the confusion. I understand that you're referring to membership subscriptions and conducting them through a legitimate registered company. In such cases, it is reasonable to expect that certain fundamental checks are in place.

Furthermore, it is irrelevant whether teenagers are actively seeking certain types of websites or not; compliance remains a necessary aspect. While I can understand the lack of enforcement concerning advertisements, it seems reasonable to expect some form of checks and regulations when a business is generating significant revenue in the range of six to seven figures annually. The crucial question then arises: is there a legal provision that permits them to forgo implementing such checks?

Typically, they manage to evade accountability by burying the exemption clause within the terms of service page, often in small print at the bottom.

I understand the gravity of the situation. Recently, the company I work for was fined $7,500 for failing to make their website accessible to people with visual impairments. I realize it may sound strange, but such incidents are rare, occurring only once in every million websites.

It is highly unlikely that someone would raise a significant complaint against a website or forum catering to swingers, taking it to an extreme level of complaint or legal action.

KYC (Know Your Customer) does not necessarily require a selfie or a copy of an ID. Having the name and age of the person is sufficient.

Additionally, as long as the content is restricted behind a login page, it is considered satisfactory. There is no explicit and openly accessible pornography, for instance.

Personally, I am opposed to both KYC procedures and captchas.

Upon discovering a website that lacks KYC (Know Your Customer) verification, one promptly exposes the situation and urges the site to implement KYC procedures. It's quite amusing, to say the least.

I appreciate your input, and I understand your stance against KYC. Your question is genuine, as you seek to gain a better understanding of the compliance requirements that you will need to fulfill.

The solution is straightforward: acquire hosting services from a country that does not mandate KYC requirements, and/or establish a company in a jurisdiction that does not enforce such obligations.
